Police and Firefighters cannot drive
as fast as they want and operation of vehicles and actions
thereof are governed by state law.
It is very common for the agency to
have additional policies and procedures regarding officer
operation of vehicles, speed, use of force, fire tactics,
fireground operations, pursuit and conduct. It is also common
for conditions (weather, traffic, etc.) to be a factor in
such policies.
Not only can the agency itself be liable
but the police officer or firefighter may also be personally
liable if negligent if "due care" for the public
or others was not exercised to written or expectant standards. |
